{"id":41,"date":"2016-09-21T13:42:37","date_gmt":"2016-09-21T17:42:37","guid":{"rendered":"http:\/\/www.winwoodinsurance.com\/blog\/?p=41"},"modified":"2016-09-21T14:44:39","modified_gmt":"2016-09-21T18:44:39","slug":"medicare-part-d-disclosure-model-notices-cms-disclosure-instructions","status":"publish","type":"post","link":"http:\/\/www.winwoodinsurance.com\/blog\/compliance\/medicare-part-d-disclosure-model-notices-cms-disclosure-instructions\/","title":{"rendered":"Medicare Part D Disclosure Model Notices &#038; CMS Disclosure Instructions"},"content":{"rendered":"<p>Notice deadline 10\/15\/16<\/p>\n<p><strong><u>There are two steps to be compliant:<\/u><\/strong><\/p>\n<ol>\n<li>Medicare eligible employees\/dependents <strong>age 65 or greater<\/strong> must be notified <strong>by October 15<sup>th<\/sup><\/strong> if the employer sponsored prescription drug plan meets or exceeds Medicare Part D\u2019s prescription drug benefits (called \u201ccreditable coverage\u201d).\u00a0 The employee\/dependent notices are attached along with instruction.<\/li>\n<\/ol>\n<ul>\n<li><strong>Note:<\/strong> Virtually all health plans pass the credibility testing. Some prescription drug plans are NOT considered creditable coverage under an H S A plan (High deductible health plan).\u00a0 If you need verification of your plan passing this test so you can send the proper notices to your employees, please reach out to us and we can help.\u00a0 Attached are the sample model notices that you would edit with your company info in it.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>Employers <strong>must go to the CMS website<\/strong> (see link below) to complete their responsibilities.<\/li>\n<\/ol>\n<p><strong><u>Here is more information on WHY you have to do this and directions as well:<\/u><\/strong><\/p>\n<p>The <a href=\"http:\/\/www.gpo.gov\/fdsys\/pkg\/BILLS-108hr1enr\/pdf\/BILLS-108hr1enr.pdf\">Medicare Modernization Act<\/a> (MMA) requires employers whose policies include prescription drug coverage to provide a <a href=\"http:\/\/www.cms.gov\/Medicare\/Prescription-Drug-Coverage\/CreditableCoverage\/Model-Notice-Letters.html\">written disclosure notice<\/a> to all Medicare eligible policyholders of whether such coverage is creditable.
