While the information reporting requirements are first effective for coverage offered (or not offered) in 2015, the initial deadlines for reporting entities are in 2016.<\/em><\/p>\n<ul>\n<li>Determine if you are a reporting entity (and what type) to understand applicable reporting requirements:\n<ul>\n<li><strong>&#8220;Section 6055&#8221; Reporting Entities. <\/strong>Self-insuring employers that provide <strong>minimum essential health coverage <\/strong>are required to report information on this coverage to the IRS and to covered individuals under section 6055 of the Internal Revenue Code.<\/li>\n<li><strong>&#8220;Section 6056&#8221; Reporting Entities.<\/strong> Employers with<strong> 50 or more full-time employees <\/strong>(including FTEs) are required to report information to the IRS and to their employees about their compliance with &#8220;pay or play&#8221; under Internal Revenue Code section 6056-even those that qualified for 2015 transition relief from the &#8220;pay or play&#8221; provisions.<\/li>\n<\/ul>\n<\/li>\n<li>Begin compiling the <a href=\"http:\/\/www.irs.gov\/uac\/Questions-and-Answers-on-Information-Reporting-by-Health-Coverage-Providers-Section-6055#What%20Information%20Must%20Providers%20Report\">required information<\/a> for section 6055 reporting and\/or the <a href=\"http:\/\/www.irs.gov\/uac\/Questions-and-Answers-on-Reporting-of-Offers-of-Health-Insurance-Coverage-by-Employers-Section-6056#What%20Information%20Must%20ALE%20Members%20Report\">required information<\/a> for section 6056 reporting.<\/li>\n<li>Review the IRS Forms and Instructions to prepare for compliance:\n<ul>\n<li><a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/f1094b.pdf\">Forms 1094-B<\/a> and <a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/f1095b.pdf\">1095-B<\/a>, along with <a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/i109495b.pdf\">Instructions<\/a>, are available for <strong>section 6055<\/strong> reporting entities.<\/li>\n<li><a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/f1094c.pdf\">Forms 1094-C<\/a> and <a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/f1095c.pdf\">1095-C<\/a>, along with\u00a0<a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/i109495c.pdf\">Instructions<\/a>, are available for <strong>section 6056 reporting <\/strong>entities (or employers that are subject to<strong> both <\/strong>reporting provisions).<\/li>\n<li><strong>Special Update:<\/strong> New <a href=\"http:\/\/www.irs.gov\/pub\/irs-dft\/f1094c--dft.pdf\">2015 Draft Forms 1094-C<\/a> and <a href=\"http:\/\/www.irs.gov\/pub\/irs-dft\/f1095c--dft.pdf\">1095-C<\/a> are now available. Draft Form 1095-C is generally unchanged from the 2014 Form 1095-C. Review the <a href=\"http:\/\/www.irs.gov\/pub\/irs-dft\/f1095c--dft.pdf\">last page of 2015 Draft Form 1095-C<\/a> for additional details.<\/li>\n<\/ul>\n<\/li>\n<li>Determine whether to hire a <strong>third party <\/strong>to fulfill reporting responsibilities (reporting entities will still be liable for the failure to report information and furnish employee statements).<\/li>\n<li>For section 6056 reporting entities, determine whether you will use the <a href=\"http:\/\/www.irs.gov\/uac\/Questions-and-Answers-on-Reporting-of-Offers-of-Health-Insurance-Coverage-by-Employers-Section-6056#Methods%20of%20Reporting\">general method<\/a> of reporting or the <a href=\"http:\/\/www.irs.gov\/uac\/Questions-and-Answers-on-Reporting-of-Offers-of-Health-Insurance-Coverage-by-Employers-Section-6056#Methods%20of%20Reporting\">simplified alternative method<\/a> to satisfy the reporting requirements.<\/li>\n<li>If the reporting entity plans to furnish employee statements <strong>electronically<\/strong> in 2016, ensure that affirmative consent is obtained from employees prior to furnishing (section 6056 reporting entities <strong>must also <\/strong>ensure that certain notice, hardware, and software requirements are met).<\/li>\n<li>Remember to comply with the information reporting deadlines for calendar year 2015.<\/li>\n<\/ul>\n<p><strong>Section 6055 Deadlines:<\/strong><\/p>\n<ul>\n<li>First information returns must be filed <strong>no later than February 29, 2016 <\/strong>(or March 31, 2016, if filed electronically).<\/li>\n<li>First employee statements must be furnished <strong>on or before January 31, 2016<\/strong>.<\/li>\n<\/ul>\n<p><strong>Section 6056 Deadlines:<\/strong><\/p>\n<ul>\n<li>First information returns must be filed <strong>no later than February 29, 2016 <\/strong>(or March 31, 2016, if filed electronically).<\/li>\n<li>First employee statements must be furnished <strong>on or before January 31, 2016<\/strong>.<\/li>\n<\/ul>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Those affected are Applicable Large Employers (ALE\u2019s). \u00a0ALE\u2019s include those that are self-insured or have over 50 full time employees (including full time equivalent employees).\u00a0 Commonly owned company\u2019s count toward the ALE calculation.
